Statement of the Restitution Proceedings and Consequences for Consumers

1. Returns
The buyer can return the goods within one month without explanation. The fixed period begins with receipt of these instructions in written form (as a letter, fax or e-mail), but not before the buyer receives the goods (for recurring deliveries of similar items, not before the buyer receives the first partial delivery) and not before the completion of the duty of the seller to inform the buyer according to Article 246 § 2 in conjunction with § 1 Sections 1 and 2 of the Introductory Law to the German Civil Code (EGBGB) as well as our duties according to § 312g Section 1 of the German Civil Code (BGB) in conjunction with Article 246 § 3 of the Introductory Law to the Civil Code (EGBGB).
Only goods which are not eligible for normal shipping as a parcel (e.g. bulky goods) can also be returned by declaring a request of return in writing. In order to comply with the one month deadline the timely dispatching of the goods is sufficient. In either case, the return is done at the cost and risk of the seller.

In case of a requisition of return, the goods will be picked up.

2. Consequences of Return
In the case of effective return, the goods and services taken by either party are to be returned and if applicable, goods and services used (e.g. compensation for use) are to be compensated. When there is a deterioration of the returned goods and for the usage (e.g. compensation for use), which results in the goods not being returned partly or wholly or only in a worse condition, compensation to us must be made. This does not apply to the goods when used as intended and the resulting deterioration must not be compensated. Value compensation when applicable to deterioration within the framework of the intended use of the goods must only be made, when the goods were used in a way that goes beyond assessing the properties and functionality of the goods. The definition of “assessing the properties and functionality of the goods” means the testing and trying on of the goods as is possible and common for buyers to do in shops. The obligation to refund payments must be fulfilled within 30 days. The time limit begins for the buyer when the goods or return requisition are shipped; the time limit begins for the seller at the receipt of sent goods or the return requisition.

3. Exclusion of the Right of Return
The right of return is not applicable to the delivery of goods which have been especially produced according to the individual requirements of the customer. (i.e. customized production, engraving etc.)
